Many new requirements have been adopted (or proposed) in the past year with regard to patient health information privacy and security regulatory requirements. The Health Information Technology for Economic and Clinical Health Act has strengthened these provisions by extending HIPAA. For example, new rules pertaining to administrative, physical and technical safeguards now apply to covered entities and their business associates (including subcontractors).
In this white paper, we describe these changes, along with other rules pertaining to breach notification, sale of PHI, marketing and fundraising restrictions, penalties for violations, and more. The paper also presents five recommendations on how organizations can begin to adjust for changes in the areas of privacy, security and enforcement.
